Six Policemen Arrested By CBI For Kashmir Constable’s ‘Custodial Torture’

The Central Bureau of Investigation (CBI) arrested eight police personnel, including at least two officers, on Wednesday in connection with the alleged custodial torture of a policeman. Last month, the Supreme Court directed the CBI to register an FIR.

The arrested policemen include a deputy superintendent of police, an inspector, and an assistant sub-inspector. The accused have been directed to surrender their weapons and other government-issued items to their respective District Police Lines.

Among the accused is a special police officer employed on an honorarium basis, who has now been disengaged and removed from the Special Police Officer (SPO) rolls.

Further details are awaited, according to officials.

On July 21, the Supreme Court directed the CBI to file a First Information Report (FIR) regarding the “brutal and inhuman custodial torture” of a police constable in Jammu and Kashmir. The Court also ordered the Union Territory administration to compensate the constable with Rs 50 lakh.

A bench comprising Justices Vikram Nath and Sandeep Mehta said the injuries caused to the constable during his illegal detention, particularly the “complete mutilation of his genitalia, use of pepper/chilly powder and electric shocks on his genitalia”, were grave reminders of the inhuman torture meted out to him.

“The cumulative effect of all these facts is deeply shocking to the conscience of this court,” the bench said, adding that the violation of Article 21 is “not only evident but egregious.” The bench observed that the constable suffered life-debilitating injuries in the custody of “fellow state actors” and despite repeated complaints, no effective redressal was provided.
