‘Hope Supreme Court Will…’: Asaduddin Owaisi On Waqf Board Order

Asaduddin Owaisi criticizes the Supreme Court’s interim order on the Waqf (Amendment) Act, urging a final verdict and alleging BJP aims to weaken the waqf mechanism.

All India Majlis-e-Ittehadul Muslimeen (AIMIM) Chief Asaduddin Owaisi has said that the Supreme Court’s interim order on the Waqf (Amendment) Act would not protect waqf properties despite certain clauses being stayed. He hoped that the top court would soon pronounce the final verdict on the entire legislation itself.

The Supreme Court on Monday passed an interim order limiting the contentious powers the new law granted to the District Collector in determining the status of a Waqf property and capped the non-Muslim representation in Waqf Boards.

Observing that the arguments of the petitioners who are opposing the Act are still “very strong”, he said they would be brought before the court when it hears the “validity or the unconstitutionality” of the legislation.

“In my view and my party’s view, the interim order will not protect waqf properties from the law the Modi government has made… encroachers will be rewarded, there will be no development in waqf properties. That’s why we hope the Supreme Court will make efforts to make a final decision as early as possible,” he said as quoted by news agency PTI.

The Hyderabad MP, who was one of the first petitioners to move the Supreme Court challenging the constitutional validity of the Waqf (Amendment) Act, further alleged that the real purpose of the BJP in making the Act was to ensure that the waqf mechanism gets weakened.

“Their whole idea is that no one should give their property as waqf,” he said.

While speaking to NDTV, Owaisi reacted to the top court’s order to stay the provision of mandating a person to have been practicing Islam for five years to create a Waqf, and said that the court has not given a complete stay, and the government should enact rules.

“The devil will be in the details. Is there such a rule for any person who embraces religions like Hinduism, Christianity, Sikhism, Buddhism, that some rules will be made before he can endow his own property to the religion he has embraced? That is not the case. So, the government would, I am sure, make rules in such a way that it will be difficult,” he told the news outlet.

Supreme Court Order On Waqf Act

The Supreme Court on Monday stayed certain provisions of the Waqf (Amendment) Act, 2025. A bench of Chief Justice of India BR Gavai and Justice AG Masih ordered a stay on multiple clauses of the law, including a clause that only those practising Islam for the last five years could create Waqf, but refused to stay the entire law outlining the presumption of constitutionality in its favour.

The Supreme Court has stayed the proviso to Section 3C(2) of the Waqf (Amendment) Act, which stated that a Waqf property would not be treated as such until a government-designated officer submitted a report on whether the land was encroached.

The Court also stayed Section 3C(3), which provided that “in case the designated officer determines the property to be government property, he shall make necessary corrections in revenue records and submit a report in this regard to the state government”.

“Presumption is always in favour of the constitutionality of a statute and intervention (can be done) only in the rarest of rare cases,” the bench said in its 128-page interim order on the contentious issue.
