‘Unverified Reports May Have Influenced…’: Lawyer On Collegium Decision To Transfer 2 Delhi HC Judges

A day after two high court chief justices were elevated to the Supreme Court despite Justice BV Nagarathna’s strong dissent to the collegium’s recommendations, there is another controversy looming on the decision to transfer justices Arun Monga and Tara Vitasta Ganju from the Delhi High Court.

Senior advocate Vikas Pahwa on Thursday wrote to Chief Justice of India (CJI) BR Gavai seeking to reconsider this decision by the collegium, which recommended Justice Monga’s transfer to Rajasthan and Justice Ganju’s to Karnataka.

In his letter, Pahwa claimed that unverified reports may have influenced the decision. “It is deeply concerning that unverified reports, wholly unrelated to the official duties or judicial work of these hon’ble judges, may have influenced the proposal for their transfer; judicial independence and continuity must be preserved,” he wrote.

He added: “While transfers undoubtedly fall within the administrative discretion of the collegium, such actions, when not grounded in judicial performance, risk unsettling not only the judges concerned but also the morale of the institution as a whole. Judicial independence and continuity must not only be preserved but must also be seen to be preserved in the eyes of the public and the bar.”

On August 27, the SC collegium headed by CJI Gavai recommended transfer/repatriation of 14 judges of various high courts, including justices Monga and Ganju. The collegium, also comprising Justices Surya Kant and Vikram Nath, took the decision in the meetings on August 25 and 26.
