Delhi HC restrains Tesla Power India from using ‘Tesla’ trademark in interim order

The Delhi High Court (HC) has granted an interim injunction in favour of US electric vehicle major Tesla Inc, restraining Indian firm Tesla Power India from using the trademarks ‘Tesla Power’ or ‘Tesla Power USA’ in any capacity, including in the manufacture or marketing of electric vehicles.

According to PTI, the order comes after Tesla Inc approached the court seeking a permanent injunction, arguing that the Indian company’s trademarks were deceptively similar to its globally recognised TESLA brand, creating a strong likelihood of consumer confusion.

While issuing the injunction, the court took note of Tesla Power India’s statement that it has no plans to manufacture electric vehicles and will not market any EVs under the disputed trademarks or any similar name until the suit is finally decided.

The interim restraint extends beyond EVs. The company has also been barred from using the marks for lead-acid batteries, inverters, UPS systems or any related products, including on websites, advertisements, e-commerce platforms or any form of marketplace outreach.

Court cites Tesla’s global reputation and prior use

Justice Tejas Karia observed that Tesla Inc had established a strong prima facie case, backed by prior registration and extensive international use of its trademark.

“Injunction is a relief in equity… the balance of convenience lies in favour of the plaintiff,” the court noted, adding that refusal to grant interim relief would cause “grave prejudice” to the US automaker.

The 52-page order, passed on November 24 and uploaded on the court’s website on November 26, highlighted that Tesla Power India appeared to be leveraging the goodwill associated with Tesla Inc, especially by adopting the name ‘Tesla Power USA’.

The court remarked that the Indian firm’s branding “appears to be with an intention to mislead customers into believing that the technology originated in the USA and that they are connected with the plaintiff”.

The matter will now proceed for further hearing as Tesla Inc continues to pursue a permanent injunction against the use of the contested trademarks.
