‘Assault On Constitution’: CJI Gavai’s Family Condemns Attack On Him Inside Court

Chief Justice of India BR Gavai’s family condemned an attempted attack on him by a lawyer during a court session on Monday, calling it an affront to the Constitution that risks spreading anarchy in the country.

During a court session before the bench led by the CJI, a lawyer allegedly approached the dais and tried to remove his shoe, apparently intending to throw it at Gavai, but security intervened and stopped him. The incident sparked widespread outrage across all political lines.

Dr Kamal Gavai, CJI Gavai’s mother, said, “I condemn the shoe thrown at CJI… The Indian Constitution gives equal rights to all, but some people, taking the law into their own hands, behave in a manner that is disrespectful to India and can spread anarchy in the country.”

“No one in this country has the right to do this. I would request everyone that whatever questions you have, whatever you want to say, please raise them peacefully,” she added.

Moreover, CJI Gavai’s sister, Kirti Gavai, also slammed the attempted attack, saying it was an attack on the Constitution. “The attack on the CJI inside the Supreme Court is not on a personal level. It is an attack on the Constitution. The Constitution is our topmost priority, and it is our responsibility to protect it.”

“This is not only for us, but also for our future generations. We have to provide a safe India to them. I urge that our work for the Constitution should be rooted in the principles of Babasaheb Ambedkar,” she added.

What Happened In Court?

The accused, who attempted to throw a shoe at the CJI, was identified as advocate Rakesh Kishore, 71, who was apparently angered by Gavai’s recent remarks on the Khajuraho temple complex in Madhya Pradesh. He was heard saying, “Sanatan ka apman nahi sahenge” (We will not tolerate the insult of Sanatan).

Justice Gavai, however, remained composed and urged the courtroom to maintain focus. He remarked that such incidents did not distract him before allowing the proceedings to continue. The episode comes shortly after the CJI had made remarks in a separate case concerning the restoration of a seven-foot beheaded idol of Lord Vishnu at Khajuraho, with critics accusing him of hurting religious sentiments.

After the incident, political leaders across party lines united in condemning the attack. Prime Minister Narendra Modi spoke to the CJI and condemned the incident, saying that it has “angered every Indian”.

“Spoke to Chief Justice of India, Justice BR Gavai Ji. The attack on him earlier today in the Supreme Court premises has angered every Indian. There is no place for such reprehensible acts in our society. It is utterly condemnable,” said PM Modi.

Congress leader Rahul Gandhi also condemned the attack, saying, “The attack on the Chief Justice of India is an assault on the dignity of our judiciary and the spirit of our Constitution. Such hatred has no place in our nation and must be condemned.”

The Bar Council of India suspended Kishore after the attack, despite CJI pressing no charges against him. Disciplinary proceedings will be initiated under the relevant legal provisions. The suspension bars him from appearing, acting, pleading or practising in any court, tribunal or authority across the country.
