Delhi High Court’s ‘Serve Pizza, Buttermilk’ Order To Neighbours Fighting Over Pets

Delhi High Court quashed FIRs between two neighbours after a pet dispute, ordering them to serve Amul Chaach and pizzas at Sanskar Ashram near GTB Hospital as community service.

In an unusual order, the Delhi High Court has directed two neighbours to serve pizzas and buttermilk to residents of a government-run childcare institution as a condition to quash FIRs they filed against each other over the handling of their pets.

A single-bench of Justice Arun Monga held that the fight was a private matter and the criminal cases against each other would “serve no useful purpose” and rather amount to an abuse of the process of law, news agency PTI reported.

“Not quashing the criminal proceedings would rather rekindle hostility, whereas quashing the same would promote cordiality and bonhomie between the neighbours,” the court said in a September 19 order.

However, it put forth a condition after noting that one of the complainants bakes and sells pizzas.

The court said that it would junk the police cases if the two neighbours served Amul ‘chach’ tetra packs and mixed vegetable pizzas at the Sanskar Ashram near Delhi’s GTB Hospital.

“Both the complainants in the two FIRs are directed to join hands and jointly bear the expenses, which shall be incurred for providing Amul Chaach tetra pack along with mix vegetable pizzas to the inmates who are currently residing at Sanskar Ashram, Near G.T.B Hospital, Dilshad Garden, Delhi.”

“Each inmate and the attendants and other staff of the Ashram shall be served one Pizza along with Amul Chaach Tetra Pack. The Pizzas shall be baked by the complainant, and the same shall be treated as the community service to be jointly carried out by all the complainants and the accused by serving the same,” the court further stated.

The court said a soft copy of the menu has been forwarded on the WhatsApp of the police official who will ensure the quality of the pizza was the same as claimed in the menu.

What Was The Case?

The incident dates back to May 5, when a heated altercation between two neighbours degenerated into an unsavoury scuffle over handling their pets.

Both parties registered FIRs invoking penal provisions such as criminal intimidation, grievous hurt, and wrongful restraint at the Mansarovar Park police station.

Later, they appeared before the court and voluntarily affirmed that they had resolved the matter and did not wish to pursue the criminal cases further. Their lawyers stated that both sides had reached an amicable settlement, noting that the FIR and cross FIRs had arisen from a significant misunderstanding.

The court quashed the FIRs to prevent undue hardship to the parties and promote mutual goodwill and societal harmony.
