Kashmir court issues NBW against Hizbul Mujahideen chief

Srinagar: A special court in Jammu and Kashmir Saturday issued a non-bailable warrant (NBW) against Pakistan-based Hizbul Mujahideen outfit supreme commander Mohammad Yousuf Shah alias Syed Salah-ud-Din in a 2012 UAPA case.A court of special judge, designated under the NIA act in central Kashmir’s Budgam ruled, “Mohammad Yousuf Shah alias Syed Salah-ud-Din is evading arrest as a non-bailable warrant is issued against him.” The court has directed J&K Police to arrest him.The court said there is enough evidence suggesting that the accused committed offences under sections 13, 18, 20 and 39 of the Unlawful Activities (Prevention) Act (UAPA), and section 506 of the Ranbir Penal Code, that was applicable in the erstwhile J&K state in 2012.Earlier, the additional prosecuting officer submitted that the accused crossed over the border and is currently in Pakistan. The officer said the SHO in Budgam and the police post in-charge at Soibugh, Budgam, have issued two separate certificates indicating that the accused is in Pakistan.The court noted that the original case diary had been forwarded to a competent authority for grant of sanction after which charge sheet would be filed before court for conducting trial in absentia.
