Preity Zinta moves court over alleged AI misuse; Bombay High Court grants permission to file injunction suit

Actress Preity Zinta has secured an important legal relief from the Bombay High Court in her battle against the alleged misuse of her identity through artificial intelligence-generated content. The actress has raised concerns about online material that she claims uses her likeness and persona without authorization.

Allegations against AI-generated content

As reported by IANS according to her plea, Preity has alleged that content generated using artificial intelligence was created and circulated across digital platforms without her approval. The actress claims that such content infringes upon her personality rights and copyright protections. She has also argued that the alleged misuse has the potential to cause reputational damage. The petition reportedly seeks legal remedies against those involved in creating, publishing or distributing such content online. Apart from personality rights concerns, the actress has also alleged a violation of her moral rights under the Copyright Act, 1957. Through the legal action, she is seeking protection against the continued circulation of the disputed material.

Bombay High Court grants permission

The matter was recently heard by a single-judge bench of Justice Abhay Ahuja. After considering the plea, the court granted permission that allows Preity to proceed with an injunction suit. The order is significant because it clears the way for the actress to formally pursue legal action against the respondents named in the matter. During the hearing, the court also considered issues relating to jurisdiction. Since several of the entities connected to the case are reportedly based outside Mumbai, questions arose regarding the appropriate forum for adjudication. The court observed that some of the alleged activities were linked to online platforms operating across multiple locations. It further noted that several respondents maintain offices beyond the territorial limits of Mumbai. Despite these factors, the court granted the required leave and clarified that it would be empowered to hear and decide the matter. The order allows the suit to move forward before the Bombay High Court.
