Sufficient funds obtained lawfully: Who can apply for Trump Gold Card visa? Form I-140G revealed

Trump Gold Card visa program petition has got a fast-tracked approval from White House.

As White House approves a fast-tracked petition for the Trump Gold Card visa, the much-anticipated visa program of the Donald Trump administration, all details of it, including eligibility, waiting time, have now been released as the program is set to begin from December 18, as earlier promised by President Donald Trump. The program in which ultra-rich foreign nationals can buy US residency comes as the administration is cracking the whip on other forms of immigration — be it the refugees or the H-1Bs. But as the details revealed, Trump’s Gold Visa is not a magic wand to enter the US. It will also have a waiting time and the due immigration process.

$1 million for individuals, $2 million for corporates

To get a Trump Gold Card, an individual must gift $1million to the US and if the application is for a corporate, they must gift the US government $2 million. The petition must establish that the applicants have sufficient funds to make the unrestricted gift to the Department of Commerce; and any funds to be used for the gift have been obtained through lawful means.

What is Form I-140?

A petitioner will have to file Form I-140G to request an employment-based immigrant visa under the Gold Card program. This form is the first step in the Gold Card process. After the petition is approved and there is an immigrant visa number available, the consular processing will begin. The Gold Card program provides eligibility for two separate immigrant visa classifications:1. First preference alien of extraordinary ability; and2. Second preference alien of exceptional ability who is seeking a National Interest Waiver (NIW).An applicant has to request one of the two classifications.

How USCIS will check applicants’ eligibility for Gold Card visa program

  • USCIS will first check whether the petition is complete or not. An incomplete petition may be rejected.
  • USCIS may request for additional information or evidence to support the petition. It may require seeing original copies of the documents.
  • During the interview, USCIS may require the biometrics to verification of identity and/or update background and security checks.
