Freed of murder charges after 43 years, why is Indian-origin Subramanyam Vedam still not free in US?

An Indian-origin man who spent 43 years in prison before his murder conviction was overturned, only to be taken straight into federal immigration custody, was denied bail as he fights deportation. After finally being released from state prison, Vedam was immediately taken into federal immigration custody and now faces deportation to India while appealing a 1999 removal order. The Board of Immigration Appeals agreed this month to hear his appeal, citing ‘exceptional circumstances’.

What led to the current legal battle?

Vedam’s legal troubles began with his conviction for the 1980 murder of a college friend. In August 2025, a Pennsylvania judge dismissed the murder conviction after discovering that prosecutors had withheld ballistics evidence during his trials.Before the murder case, Vedam had served time in the 1980s for small-scale LSD delivery. His lawyer, Ava Benach, says that the drug charge was minor and occurred more than 40 years ago, far from large-scale drug trafficking. However, federal immigration authorities cited the drug felony as grounds for deportation, arguing it makes Vedam a potential safety risk despite decades of rehabilitation.

Current status

  • Bail denied: An immigration judge in New Jersey ruled that Vedam’s detention is mandatory due to the felony drug conviction, while also agreeing with authorities who claim he remains a safety concern.
  • Appeal underway: The Board of Immigration Appeals has agreed to hear Vedam’s appeal, citing “exceptional circumstances.” No hearing dates have yet been scheduled.
  • Support and advocacy: Vedam’s family and local officials have rallied behind him, highlighting his long-term rehabilitation, exoneration, and his contributions to the community’s trust and safety.
