The Supreme Court on Friday issued a set of guidelines aimed at addressing delays in the pronouncement of judgments by High Courts after completion of hearings.
As per the directions issued by the apex court, judgments reserved by High Courts should ordinarily be pronounced within three months.
The Supreme Court also directed that in bail matters, efforts should be made to pronounce orders by the following day. Information regarding such orders should be communicated to jail authorities on the same day to ensure prompt compliance.
The court further stated that undertrial prisoners should ideally be released either on the same day or the next day after the bail order is passed.
According to the guidelines, the operative portion of a judgment should be pronounced in open court, while the detailed order containing reasons should be uploaded within seven days.
The apex court also directed that the date on which a judgment is reserved must be displayed on the respective High Court’s official website.
In cases where a bench fails to comply with the prescribed guidelines, the matter may be reassigned to another bench.
Additionally, the Supreme Court said that if reasons for a judgment are not uploaded within 30 days, the case can also be transferred to a different bench for further proceedings.
The guidelines have been issued to improve judicial transparency, reduce delays in delivery of verdicts, and ensure timely relief to litigants, particularly in bail-related matters.
