Singer D4vd, whose real name is David Anthony Burke, could face the death penalty if he is found guilty in the murder of 14-year-old Celeste Rivas Hernandez. On July 27, the Los Angeles District Attorney’s Office said Burke is legally eligible for the death penalty because of the charges against him. However, prosecutors have not yet decided if they will ask for that punishment. The decision will come later as the case moves forward. Burke has pleaded not guilty to all the charges against him.

D4vd has been ordered to stand trial after a judge found there is enough evidence for the case to move forward. The singer faces three serious charges: murder, continuous sexual abuse of a child under the age of 14, and unlawful mutilation of human remains. According to the Los Angeles District Attorney’s Office, if Burke is convicted on all the charges, he could receive either the death penalty or life in prison without the chance of parole.District Attorney Nathan J. Hochman said that no final decision has been made about asking for the death penalty. He explained that the process takes time and that prosecutors will carefully review all the information before making that choice. Burke has pleaded not guilty, which means he denies all the charges against him. His legal team will have the chance to present information and arguments before prosecutors decide whether they will seek the death penalty.

Speaking to reporters outside the courthouse on July 27, Hochman said Burke is now legally eligible for the death penalty because of the charges in the case. However, he made it clear that eligibility does not mean prosecutors have already decided to seek it.“The death penalty considerations are now being weighed,” Hochman said. He added that the defence can also send information to the District Attorney’s Office, and prosecutors will review those materials before making a final decision.For now, the case will continue through the court process. Burke’s next court hearing, known as a post-preliminary arraignment, is scheduled for August 31 in Los Angeles.The case against D4vd has now entered its next stage after the court ordered him to stand trial.
