‘Kala Hiran’ makers respond to Salman Khan’s petition, next hearing Monday

'Kala Hiran' makers respond to Salman Khan's petition, say the film hasn't been sent to CBFC for certification, hearing adjourned till Monday

Actor Salman Khan’s petition against the makers of the upcoming film Kala Hiran was heard by the Delhi High Court on Friday. The matter has now been adjourned until Monday after the filmmakers assured the court that neither the film nor its trailer would be released before the next hearing.During the proceedings, counsel representing the filmmakers informed the court that only a teaser of ‘Kala Hiran’ has been made public so far. The lawyer also said that a detailed response to Salman Khan’s petition would be submitted and clarified that the film itself has not yet been released. The filmmakers further assured the court that they would not send the film to the Central Board of Film Certification (CBFC) for certification until Monday.Justice Jyoti Singh said that if the filmmakers were confident the film would not be released in the coming days, they should formally place that assurance on record. The court asked their counsel to seek instructions from the clients and return with a clear stand. After consulting the filmmakers, their lawyer pointed out that Salman Khan had not impleaded the CBFC as a party in the case. The counsel argued that no film can be released without obtaining certification from the board and reiterated that ‘Kala Hiran’ has not yet been submitted for approval.”We will not send it to the CBFC till Monday,” the lawyer assured the court. Taking note of the statement, the High Court recorded the filmmakers’ response and directed that the matter be listed for hearing on Monday.Earlier, Salman Khan’s counsel had urged the court to direct the filmmakers to make a formal undertaking that the film would not be released in the meantime. Describing the matter as one involving the alleged infringement of the actor’s personality rights, the lawyer sought interim relief. The court subsequently accepted the filmmakers’ undertaking that the film would not be submitted to the CBFC before Monday and scheduled the next hearing accordingly.Salman Khan has approached the Delhi High Court seeking relief against the makers of ‘Kala Hiran’, More details regarding the dispute are expected to emerge when the matter is taken up again next week.
