Delhi High Court protects Hrithik Roshan’s property rights

Delhi High Court protects Hrithik Roshan’s property rights: AI content, unauthorized commercial links to be taken down

In the age of AI and Deepfake technology, concerns regarding identity rights are more alarming than ever. Thus, several Bollywood actors reached the High Court to seek protection for their personality rights. Recently, Hrithik Roshan also knocked on the court’s door for the same matter, and he has received relief, as the ruling has come out in his favor. On Wednesday, the Delhi High Court passed an order for the removal of certain links and listings from various social media and e-commerce platforms.

According to Live Law, the Delhi High Court ruled in favor of the removal of some links, including the AI content related to the actor. However, it has declined to grant ex parte relief against Instagram pages and fan clubs. Justice Manmeet Pritam Singh Arora highlighted that at this stage, Hrithik’s fanpages could not be taken down since the content has no commercial or defamatory elements. Senior Advocate Sandeep Sethi, representing the ‘Krissh’ actor, said that Roshan’s images and name were being used to sell merchandise, and his videos were being used for dance tutorials in an unauthorized manner.

What did the court say?

However, the court noted the non-commercial use of the videos and said, “It’s a song which is of Hritik Roshan, which they will be using for a dance tutorial. They are using that performance to teach people. It is not commercial merchandise. At this stage, I am not persuaded by this…This is available in the public domain. Anybody can use this.” “We can’t have fan clubs taken down at the ex parte stage. Let this be for a later stage. I am not willing to take down fan pages. We will ask them to provide you BSI details. I understand commercialization, morphed, obscene, but I don’t understand fanclub takedown…Instagram use is not only commercial. People do it for fun and recreation. These pages are not defamatory to you at all,” the court added.Meanwhile, other Bollywood artists like Akshay Kumar, Aishwarya Rai Bachchan, Abhishek Bachchan, filmmaker Karan Johar, singer Kumar Sanu, and Telugu star Nagarjuna have reached the court seeking protection for their identity rights.Disclaimer: The information in this report is based on a legal hearing as reported by a third-party source.
