‘Kanyadaan Means Gotra Change’: Supreme Court In Childless Widow Inheritance Case

The Supreme Court observed that under Hindu law and marriage customs, a woman’s gotra -her ancestral lineage- changes after marriage, as it began hearing a challenge to a provision in the Hindu Succession Act (HSA) that directs the property of a childless widow to her husband’s family rather than her parents.

Justice BV Nagarathna, the sole woman judge on the bench and in line to become the first woman Chief Justice of India, referred to the concept of kanyadaan, saying, “When a woman marries, her gotra also changes. Marriage rituals, especially in South India, declare that she is moving from one gotra to another.”

She added that the Supreme Court did not wish to “break something which has existed for thousands of years” by its ruling.

What The Case Is About?

The key legal question before the Supreme Court is: who inherits the property of a childless Hindu widow who dies without leaving a will? As per current law, section 15(1)(b) of the Hindu Succession Act states that in such cases, the widow’s property passes to her husband’s heirs.

The Supreme Court was informed of recent cases highlighting the issue as in one instance, a young couple died due to COVID-19, leading to a legal battle between the mothers of the deceased man and woman over inheritance. In another, a man’s sister staked claim to the property left behind by her brother and sister-in-law, who had died childless.

Justice Nagarathna said that under Hindu law responsibility for a woman after marriage lies with her husband and his family.

“A married woman will not file a maintenance petition against her brother,” she said, adding that a woman has the freedom to make a will during her lifetime or remarry, which would alter succession.

The Supreme Court has referred one of the inheritance disputes to mediation and has scheduled the broader hearing on the legality of Section 15(1)(b) of the Hindu Succession Act for November.
