Battle of wills: Delhi HC tells Sunjay Kapur's wife to disclose his assets

NEW DELHI: Delhi high court on Wednesday asked the late Sunjay Kapur’s wife, Priya, to disclose all his assets, both movable and immovable. HC was hearing a suit filed by the two children from Kapur’s former wife, Karisma Kapoor, asserting their claim to a share in their father’s personal estate. Priya informed the court that the two children had already received Rs 1,900 crore in assets from the family trust, and asked, “What more do they want?” Justice Jyoti Singh registered the plaint by Samaira Kapoor, 20, and 15-year-old minor son also challenging the purported will of their late father and issued notice to Priya, posting the matter for Oct 9.Appearing for Priya, senior advocate Rajiv Nayyar contested the claim that his client forged the will to gain control over all assets. When the high court queried if the will was registered, Nayyar replied it wasn’t but was valid.”It’s not registered. Unregistered does not take the nature away. All this crying and weeping that is going on, just six days before the suit, the plaintiffs received Rs 1,900 crore from the trust,” the counsel contended, citing Karisma’s divorce proceedings with Sunjay.”There were litigations after litigation, and it ended in acrimonious divorce proceedings in the Supreme Court. At the age of 50, a man dies. I am a widow and have a six-year-old child. Where were you all this while? You were nowhere to be seen for the last 15 years. It’s not as if these people are left on the streets,” the counsel said.

Senior advocate Mahesh Jethmalani, appearing for Karisma’s children, argued that the will was never disclosed earlier, is unregistered, and was read “in haste” at the family meeting. He further pointed to “suspicious circumstances”, noting that the executor herself admitted learning about the will only a day before and that its disclosure came from a family employee.When asked, Priya’s counsel confirmed the will was in their custody and placed it before Justice Singh, who examined it. The court then suggested that the will be shared with the children subject to a non-disclosure agreement.Sunjay’s mother, Rani Kapur, also assailed the will, saying it left nothing to her, terming the entire process “unholy”. Appearing for the mother, senior advocate Vaibhav Ghaggar informed HC she wrote at least 15 emails asking about the will.”What are the documents? Not a word has been shared.
