F1 visa rejected on 214(b)? Former visa officer explains what to do now, before applying for it again

F1 visa rejected on 214(b)? Former visa officer explains what to do now, before applying for it again

Former visa officer explains what to do after your F1 visa gets denied.

Former visa officer Yvette Bansal explained that most of the F1 visa applicants in India are getting rejected on 214(b), and it means teh visa has been refused on either of the following grounds: whether you will use the visa class appropriately, whether you are able to finance your education, if you are a genuine student or not. “It’s not a permanent ban. It is a refusal that another visa officer can choose to overturn, but the refusal will always be on your record,” Bansal said in a podcast.

What do visa officers write during a refusal?

Bansal, who worked as a visa officer in the Mumbai consulate, said visa officers write notes when they refuse a case, and that note also stays in the record. Depending on how harsh the note is the applicant may get another shot at an F-1 visa. “It’s like a softer ‘I am not sure about this person’ versus harsher ‘this person is straight up lying to me’. These refusal notes do go a long way,” Bansal said adding that in some cases these refusals are hard to overcome.”If you feel like you have a strong case but the officer did not give you a fair chance or you really got nervous at the window, you can try again. But if the officer spends 8-9 minutes with you going over your finances, and you gave your best shot, then the refusal might be a little harsher, and so you should strengthen your case before applying again,” Bansal said.

Ties to the country are different for B1/B2 and F1

Bansal explained that ‘ties to the country’ are different for tourist visa applicants and student visa applicants. For B1/B2 visas, officers check if you have property here, but for F1, officers check if you have a lot of education here, which you won’t risk in the US by becoming an illegal. If a student has a family business, it is also a tie — the more you have to lose if you become an illegal in the US are the more ties you have to your home country.

What to do after an F1 visa refusal?

The consular officer does not have access to your grades, so a better university will show your aptitude, Bansal said, adding that only a better university, however, can’t clear the interview. The entire story has to be cohesive — your current degree, your future degree and what you plan to do. “In India, you have to wait for a year to get another shot at an F-1 visa. So applicants who got refused should upskill themselves, look for an internship, and seek a bump in pay if they are working,” Bansal said. Go to Source
