Delhi HC issues notice on Salman Khan's plea seeking stay on 'Kala Hiran' for violating his personality rights, hearing on June 19

On Friday, several reports suggested that Salman Khan has approached the Delhi High Court to seek stay on the film, ‘Kala Hiran: The Battle for Legacy’ alleging that it violates his personality rights. As per the latest update, the court has issued a notice on the interim application filed by the actor seeking to restrain the makers from releasing the film. This comes when the ‘Kala Hiran’ makers have already dropped the film’s teaser which shows an actor just looking like Khan, wearing his signature bracelet. A vacation bench led by Justice Neena Bansal Krishna took up the actor’s plea, which forms part of a broader suit filed by Khan to protect his personality rights. The court issued notice to the defendants and is scheduled to hear the matter next on June 19.Representing the actor, advocate Nizam Pasha argued that the film’s promotional material makes direct references to Salman Khan and unlawfully exploits his identity. He informed the court that a poster released on May 29 featured an individual bearing a close resemblance to the actor and cited a previous High Court order recognising and protecting Khan’s personality rights.Addressing the court, Pasha said, “A film is sought to be made exploiting my personality rights. We are asking for an injunction on this film.Total 4 FIRs, in 3 i have been acquitted. Now film is made exploiting my personality rights. Every day in press my name is bandied. We are asking for injunction of the film. This morning they have released trailer.”The court then inquired about the film’s release date. In response, Pasha stated that while the trailer had already been unveiled, no release date had yet been announced.”We are asking for this project to be injuncted,” he said. The court observed that notice would have to be issued to the defendants before any further orders could be considered.In his petition, Salman Khan has alleged that the film is inspired by the 1998 blackbuck poaching case and his alleged conflict with gangster Lawrence Bishnoi. According to the plea, the promotional content includes a lookalike of the actor sporting his signature blue bracelet, a feature that has become closely associated with him over the years.The actor has further objected to a poster that allegedly depicts the lookalike carrying a rifle or firearm. The plea argues that such imagery creates a misleading narrative, particularly because Khan was acquitted in the Arms Act proceedings linked to the case.The petition also claims that despite receiving a legal notice on April 24, the filmmakers continued promoting the project and allegedly shared content connecting the film to the actor.Describing the film as a violation of his recognised personality rights, Salman Khan has sought immediate relief from the court to prevent the development, production, promotion and publication of ‘Kala Hiran: The Battle for Legacy’ until the matter is adjudicated.
