A federal judge ruled that US President Donald Trump overstepped his authority by deploying National Guard troops to Southern California during immigration protests earlier this summer, finding the move breached a law barring the military from domestic law enforcement.

US District Judge Charles Breyer issued the decision, siding with California in its challenge to the administration’s actions. While Breyer did not order an immediate withdrawal, his ruling will take effect on Friday this week, curbing the deployment.

The lawsuit, brought by California officials, argued that Donald Trump’s use of Guard troops in Los Angeles effectively turned soldiers into immigration police- a violation of the Posse Comitatus Act, which restricts the military from performing civilian law enforcement. State attorneys called the ruling a victory for constitutional limits as one said, “The military is not a political tool.”

Lawyers for the Donald Trump administration countered that the National Guard was not conducting arrests but providing protection for federal agents and that Donald Trump retained broad authority to mobilize troops under national security statutes. They argued the deployment was lawful and necessary to contain unrest.

The ruling comes as Donald Trump faces mounting criticism over his push to expand military deployments in Democratic-led cities, including Chicago, Baltimore and New York. California leaders welcomed judge Breyer’s decision as a rebuke of federal overreach. For now, the ruling places new legal limits on the administration’s ability to wield military force in immigration enforcement, setting the stage for a likely appeal from the White House.
