Lamborghini Case Update: Court Hearing Concludes, Decision on Police Remand Awaited

The court hearing in the high-profile Lamborghini case concluded after nearly 35–40 minutes, with police seeking custodial remand of accused Shivam Mishra. The court has reserved its order, and a decision on the remand plea is expected shortly. During the proceedings, detailed arguments were presented by the Investigating Officer (IO), the government counsel, and the defense, while the judge raised pointed questions regarding the basis of Mishra’s arrest. The court asked police to clarify why the arrest was made and under which provisions of the Bharatiya Nagarik Suraksha Sanhita (BNSS). Police stated that Mishra was arrested under Section 35 of the BNSS, claiming he was not cooperating with the investigation. However, the judge questioned how he had failed to cooperate and whether proper notice had been served, including whether sufficient efforts were made to reach him in Delhi. The court also examined whether Supreme Court guidelines—particularly in cases involving offenses punishable by less than seven years—had been followed. The defense argued that the arrest violated established legal procedure, asserting that Mishra should have been granted bail at the police station level. They further claimed he was detained from an ambulance before being presented in court.
